Hereinafter referred to as "Sacred Gallery", "us" or "we". People who visit our site and/or use our services will hereinafter be referred to as "you" or "consumer". If you have any questions about the Terms and Conditions, please feel free to contact us by mail eshop@sacred-gallery.com. By placing an order you agree to these written terms and conditions. Please ensure that you have carefully read and understood the terms and conditions before placing your order as these terms and conditions are legally binding.

With these terms and conditions, we strive to reflect current legislation in the field of consumer and commercial law. We reserve the right to change these terms and conditions without prior notice. The applicable version of the terms and conditions that will apply to your order will always be the version that is on sacred-gallery.com at the time you place your order.

The Terms and Conditions do not apply where the person intending to purchase goods from the Seller is a corporation or a person acting in the course of his or her business or self-employment when ordering goods.

 Provisions deviating from the terms and conditions may be agreed in the contract of sale. Deviating provisions in the contract of sale take precedence over the provisions of the terms and conditions. 

The provisions of the terms and conditions are an integral part of the purchase contract. The Purchase Agreement and the Terms and Conditions are drawn up in the Czech language. The contract of sale may be concluded in the Czech language.

 The Seller may change or supplement the wording of the Terms and Conditions. This provision does not affect the rights and obligations arising during the validity of the previous version of the terms and conditions.
 

The right to use our services

When you buy online, you enter into a mutual agreement with us. You must be of legal age to do so or enter into a contract. However, this does not mean that minors may not shop on our website. If you have not yet reached the age of majority, you only need your parent's permission to shop. As a parent, please be aware that by giving your child your bank or card information, you have made a purchase. This means that even if your child went shopping without your knowledge, the purchase was legally authorized when you gave them your card information. Sacred Gallery also reserves the right to refuse a sale if it suspects that a person is using a card that belongs to someone else. When purchasing one of our partner stores, be prepared to show proof of identity.

User account

Based on the buyer's registration on the website, the buyer can access its user interface. The buyer can order goods from his user interface (hereinafter referred to as "user account"). If the web interface of the store allows it, the buyer can also order goods without registration directly from the web interface of the store.

When registering on the website and when ordering goods, the buyer is obliged to enter all data correctly and truthfully. The buyer is obliged to update the data specified in the user account in case of any change. The data provided by the buyer in the user account and when ordering goods are considered correct by the seller.

Access to the user account is secured by a username and password. The buyer is obliged to maintain confidentiality regarding the information necessary to access his user account.

 The buyer is not authorized to allow the use of the user account by third parties.

 The seller can cancel the user account, especially if the buyer does not use his user account for more than 6 months, or if the buyer violates his obligations under the purchase contract (including the terms and conditions).

 The buyer acknowledges that the user account may not be available continuously, especially concerning the necessary maintenance of the seller's hardware and software equipment, or necessary maintenance of hardware and software equipment of third parties.

Prices and payment

We design and sell products through the direct sales method through our website, through distributors, or through our partner stores. We try to offer the best quality and original goods on the market at an affordable price.

The cost of shipping outside the Czech Republic depends on the country from which we received the order.

We accept payment by bank transfer and payment card through the provider. The Sacred Gallery e-shop cannot display or access your bank account. These data are encrypted and can only be manipulated by your bank. It is also responsible for payment security.

Delivery and costs

Paintings can be picked up in person at Komerční 524, 251 01 Nupaky u Prahy.

Other products can be picked up in person atV Závětří 1478/6, Prague 7, Holešovice.

We currently deliver to the Czech Republic, Slovak Republic, Austria, Germany, Italy, France, Great Britain and Switzerland.

The delivery time (production time) for paintings is 10 days + approx. 2-3 days for shipping. But we can usually do it sooner. We deliver the other assortment within 5-7 days from the creation of the order.

As soon as we have prepared your order, you will receive a shipping notification by email.

We are not responsible for late delivery if courier services have any delays or technical problems.

Complaints procedure

If you want to return the product for any reason, simply write to us in advance to email eshop@sacred-gallery.com and then we will agree on the next steps.

General principles:

The buyer is obliged to check his shipment directly upon delivery from the carrier (if it is broken, etc.), otherwise the claim caused by the transport will not be recognized. If the buyer discovers a defect in the goods caused by improper handling during transport, he will not accept the shipment.

We are responsible for defects that the goods have upon delivery and that will manifest themselves in the following 24 months. However, we are not responsible for newly created defects, especially if they were caused by inappropriate use. For used goods, we are not responsible for defects corresponding to the degree of use or wear and tear that the used goods had when you took them over. In the case of goods with a marked shelf life, we are also responsible for the fact that the goods will be suitable for use during this period.

Please note that defects in gifts and other free services that we provide beyond the scope of your order cannot be considered a defects in the goods.

The images of the goods in our online store are illustrative and do not represent a binding representation of the properties of the goods (the packaging of the goods may differ, for example, due to a change in the packaging by the manufacturer).

As a Sacred Gallery customer, you have a 14-day right to return goods. The product should be returned unused, undamaged, and in the original packaging together with the supplied accessories. Of course, you can open the package and try it before you decide. If the buyer was given a gift together with the goods, the buyer must return it together with the goods when withdrawing from the contract.

General procedure:

  • If you want to return the goods and money within the legal period of 14 days from receipt, i.e. it is a withdrawal from the contract, please fill out the following withdrawal formsign and scan the selected form, and send it to email: eshop@sacred-gallery.com.

  • If you only want to complain about the goods, please fill out the complaint form, sign and scan the selected form, and send it by email eshop@sacred-gallery.com.

  • We will then ask for further information and agree on the next course of action.

  • PWhen prompted by us by e-mail, pack the goods and send them back to:

  • Make sure you pack the item securely so it doesn't get damaged in transit. The consumer pays the shipping costs.

  •  After receiving the goods, we will contact you by email with a statement. We usually return the money within 14 days of the statement.

Protection of personal data and Cookies

The Sacred Gallery e-shop works following the GDPR and does not collect your personal data without your consent. We will only request the data we need to offer you the best products and services. This includes, for example, your name, and address.

The Sacred Gallery e-shop will not sell your personal data to third parties and we will not collect any information about you that was not voluntarily provided. Please note that you can request access to any personal data we hold about you at any time – this is your legal right. If you are not comfortable with us keeping your personal data, do not hesitate to contact us. Requests for obtaining or deleting personal data must be submitted personally in writing and signed by you. Our main goal is for you to feel safe and satisfied with our services.

This website uses cookies for a pleasant user experience. A cookie is a text file stored in the browser to optimize the functionality of the website. If you have purchased any of our products from us and want to buy new and sell old, we have no problem with that and it is your full and legal right. However, you may not use the product for commercial purposes without our consent. In addition, we do not allow you to purchase our products to modify, deconstruct or disassemble for commercial purposes. That doesn't mean we don't welcome cooperation and help selling our products!

 You are a distributor of paintings or reproductions or posters. Or if you own a painting and reproduction shop or a design shop, don't hesitate to contact us! In that case, contact us at eshop@sacred-gallery.com.

After reading the text above, it may sound like we don't allow you anything. This is not true! You can buy as many of our products as you want, post tons of pictures of your amazing images on Instagram and Facebook, and tell your friends where to find the best images.

 This warranty does not cover damage caused by:

1. Commercial use of products.

2. By wear and tear, abuse or negligence of the customer. Damage due to the negligence of the customer is characterized by any damage caused by indirect, direct or accidental actions and circumstances. This includes but is not limited to: collision with a surface or other objects, fire, fire, spilled food or liquid, misuse, incorrect or unauthorized repairs, alterations, unusual stress on the product for which it was not certified or improper modifications. If the product is returned with removed, damaged or other and otherwise damaged labels, we will not be able to provide any warranty repairs and services.

 To submit a request to repair a damaged image, write and explain your problem by e-mail at eshop@sacred-gallery.com preferably with high-quality photos.

 If you choose to send a product to our Repair Department, please email us ateshop@sacred-gallery.com to notify us of your incoming package. Use the subject line "FIX" in your email and include:

• Photo receipt or invoice (if purchased from one of our official retailers, please include some form of proof of purchase.

• High-quality photos of the damaged area.

 Our customer support team will inform you about the next steps.

Repairs can take 6-8 weeks, in some cases we will need to extend the time, depending on the condition of the product, what components are necessary to repair, and the lead time to complete the repair.

 Damage that is not covered by our 2-year warranty can still be repaired, however, these repairs will be charged as part of the individual part price list sent by us along with the hourly labor rate and the number of hours required to complete the repair. Charges may also apply to repairs under the 2-year warranty if our Quality Assurance Department concludes that the damage is caused by misuse or mishandling by the customer.

 In such cases, we will always inform you and require your consent to repair within the official price list. If you do not agree to the paid repair of your image, we will send it back to you in the condition in which it was sent to us.

If you choose to decline the service repair, Sacred Gallery will ship the product back to the address from which the package was shipped. You pay the shipping costs to your address.

If you require further clarification regarding the repair process, please do not hesitate to contact us at eshop@sacred-gallery.com with a request for information related to your repair request.

Dispute resolution

Mutual disputes between the seller and the buyer are resolved by the general courts. According to Act No. 634/1992 Coll., on consumer protection, as amended, the buyer who is a consumer has the right to an out-of-court settlement of a consumer dispute from a purchase contract or a contract for the provision of services. The entity that is authorized to conduct out-of-court dispute resolution is the Czech Trade Inspection.

More information is available on the website www.coi.cz. An out-of-court settlement of a consumer dispute is initiated exclusively at the consumer's proposal, and only if the dispute cannot be resolved directly with the seller. The proposal can be submitted no later than 1 year from the day the consumer exercised his right, which is the subject of the dispute, with the seller for the first time.

 The consumer has the right to initiate out-of-court dispute resolution online through the ODR platform available at ec.europa.eu/consumers/odr/.

The seller undertakes to preferentially seek out-of-court settlement of disputes with the buyer if the buyer does not reject them. Out-of-court settlement of disputes can also be done through the VašeStížnosti.cz service on the website www.vasestiznosti.cz.

 This procedure is not a mediation under Act No. 202/2012 Coll., on mediation, as amended, nor an arbitration proceeding under Act No. 216/1994 Coll., on arbitration proceedings and enforcement of arbitration awards, as amended, and its use has not affected the right of the parties to address their claim to the Czech Trade Inspection or the court.

During the duration of the negotiations on the out-of-court settlement of the dispute, the statute of limitations and preclusion periods according to the Civil Code do not run or start to run, until one of the parties to the dispute expressly refuses to continue the negotiations. 

The seller undertakes, in the case of the buyer's consent, to strive for the fulfillment of dTest's recommendation opinion. 

Supervision of compliance with obligations under Act No. 634/1992 Coll., on consumer protection, as amended, is carried out by the Czech Trade Inspection (www.coi.cz).

Other

For these terms and conditions, the buyer is understood as a consumer, which is a person who, unlike the seller, does not act as part of his business activity or as part of the independent performance of his profession when concluding and fulfilling the contract.

 For these terms and conditions, the seller is an entrepreneur who, unlike the buyer, acts as part of his business activity or in the independent exercise of his profession when concluding and fulfilling the contract. Other matters not mentioned here are governed by the Civil Code (No. 89/2012 Coll.), the Consumer Protection Act (No. 634/1992 Coll.) and other legal regulations, as amended by later legal regulations. 

The contract and related issues are governed by Czech law.

Changes to business conditions in a form other than mutually agreed upon in writing are excluded.
